That the minutes of November 28, 2023 are approved as presented.

That the Committee of Adjustment approve the application based on the revised recommendation: The application A-2023-039 by Ngoc Danh Pham be conditionally approved by permitting a variance to the special building setback, minimum landscaped open space, and reduction to the rear yard and side yard setbacks as it maintains the general intent and purpose of the Official Plan, maintains the general intent and purpose of the Zoning By-law, is desirable for the appropriate development of the land, building or structure; and is minor in nature. The variance is conditional upon:  The hard landscaped area is not permitted to be used as a surfaced parking area and be restored to sod prior to any variance being finalized by July 1, 2024, and;  0.3 metre setbacks from the lot lines are provided and the gutters project no more than 0.15 metres from the accessory structure and will be revised accordingly."

The the Committee of Adjustment approve the application based on the recommendation report with the revised condition:  A revised site landscaped plan for Part 3 Landscaped Open strip be required that illustrates the reduced landscaped open strip from 6 metres to 2.5 metres only at the pinch point.
